  • If elected, this will be India's 9th time on the UNSC.
  • The election will be held in June 2027. The other contestant for the one seat from Asia is Tajikistan.

Who the members of the UNSC are

  • Who are the members of the UNSC?
  • The United Nations is divided into five regional groups representing Asia, Africa, Latin America, Eastern Europe, and Western Europe & Others (WEOG). The latter comprises the United States, Canada, Australia, New Zealand and Israel.
  • The Eastern Europe group is reminiscent of the Cold War era, with the UNSC's permanent membership (P5) of the United States, United Kingdom, France and Russia also representing the victorious Allied powers, plus China.
  • The UNSC also has 10 non-permanent members elected by the UN General Assembly for two-year terms. These include three from Africa, one from Eastern Europe, and two each from Asia, Latin America and WEOG.

  • Five elected members retire every year, making way for a rotation among the non-permanent members.
  • Pakistan is presently a member of the UNSC from Asia, having joined in 2025-26, while Bahrain's tenure expires in 2027. Kyrgyzstan will replace Pakistan in 2027 and serve through 2028.
  • From an outsider's perspective, India's contest against Tajikistan should be a no-brainer given our global standing and G-20 membership, among other things. However, elections at the UN can unfold in strange ways.

The lesson from this June's votes

  • What happened this June
  • In a three-way contest for two seats among the Western countries, Portugal and Austria pipped major economy Germany. As a large financial contributor to the UN and aspirant for permanent membership of the UNSC, the Germans have sought UNSC membership every seventh or eighth year, having last served the 2019-20 term.
  • Since the election was a secret ballot, it is unclear what unfolded. However, there appears to be a growing discontent among the Global South over Germany's views on Israel's war in Gaza. It also signalled a certain solidarity among the smaller UN member countries against global heavyweights.
  • At the same time, in the Asian group, Kyrgyzstan defeated the Philippines, a longtime UN member that enjoyed ASEAN backing. The Kyrgyz obtained 142 votes out of 191 cast and comfortably crossed the two-thirds requirement of 127 votes, thanks to the support of the 50-plus-member Organisation for Islamic Cooperation (OIC) group, to which it belongs, as well as what appears was strong Chinese support.
  • There was also a contest for the UNGA Presidency this time, in which the Foreign Minister of Bangladesh got the better of the candidate from Cyprus. Here too, factors similar to what benefited Kyrgyzstan and saw the defeat of Germany were in operation.
  • In the normal course, Kyrgyzstan's UNSC membership meets the need for Central Asian representation and should make India's path to the UNSC easier. However, the reasons for the Kyrgyz and Bangladesh victories and the German loss underscored the need for a robust global campaign by India, which has been launched well in time.
  • The 2010 precedent
  • In 2010, India faced a similar situation with Kazakhstan. This was avoided by leveraging strong bilateral ties, with the Kazakhs repositioning their candidature to 2017-18. While election was assured, sustained diplomatic efforts in New York and across the globe saw India secure a record 187 votes, signalling global acceptance for India's permanent membership of the UNSC.

  • "Wither UN" is a much-heard phrase nowadays. While the powerful always have power at their disposal, de jure global legitimisation requires the UN. Indeed, even the US needed a UNSC resolution to establish President Trump's signature peace initiative, the Board of Peace (for Gaza).
  • On our part, most of the countries included in the major diplomatic outreach mounted as part of Operation Sindoor were those that were serving on the UNSC in 2025 and would do so in 2026 — the two years when Pakistan was a member.
  • To date, Pakistan has not been able to use its membership of the UNSC to pressure India; on the other hand, the UNSC adopting a resolution condemning the Pahalgam terrorist attack was important for India.

  • The SC held that elephant corridors are not State-specific, as elephant herds naturally move across multiple States. Conservation therefore requires inter-State coordination.
  • The Court highlighted the inter-state and trans-national nature of elephant movement, citing examples of herds travelling from Nepal through West Bengal to Jharkhand, and from Yamuna Nagar in Haryana to Uttarakhand and Himachal Pradesh.

  • At the 12th BRICS Environment Ministers' Meeting held in New Delhi, member nations strongly opposed the European Union's Carbon Border Adjustment Mechanism (CBAM) and urged developed nations to urgently scale up adaptation finance ahead of the upcoming United Nations Climate Change Conference (COP31).
  • BRICS nations criticised the EU's CBAM, labelling it a "unilateral, punitive, discriminatory, and protectionist" measure that threatens to undermine developing nations' efforts to build climate resilience.

What CBAM is and what it covers

  • The mechanism, which entered its definitive phase on 1st January 2026, mandates that importers of carbon-intensive goods – specifically iron and steel, aluminium, cement, fertilisers, hydrogen, and electricity – must account and pay for the carbon emissions associated with their production.
  • The European Union claims CBAM is necessary to prevent "carbon leakage" – a phenomenon where carbon-intensive production shifts to countries with less stringent climate policies to avoid emission costs.
  • It is part of the EU's "Fit for 55" package, which aims to reduce greenhouse gas emissions by at least 55% by 2030 compared to 1990 levels.

The impact on India

  • The SHANTI Act, 2025 replaced the Civil Liability for Nuclear Damage (CLND) Act, 2010, aiming to facilitate private-sector participation in India's civil nuclear sector by easing stringent liability norms and establishing a predictable civil liability framework.
  • Under the Act, a "company" has the meaning assigned under Section 2(20) of the Companies Act, 2013, but excludes companies incorporated outside India.
  • It gives the AERB statutory status to strengthen regulatory authority and nuclear safety oversight.
  • Strategic State Control
  • The Act reserves sensitive activities such as uranium enrichment, spent-fuel reprocessing, high-level waste management and heavy-water production for the Central Government or its wholly owned institutions.

  • State Absorption

  • Major International Nuclear Liability Conventions
  • Paris Convention on Third Party Liability in the Field of Nuclear Energy (1960): An OECD Nuclear Energy Agency (NEA) regional framework establishing strict and channelled liability for nuclear damage.
  • Vienna Convention on Civil Liability for Nuclear Damage (1963): An International Atomic Energy Agency (IAEA) framework that harmonises national laws and establishes minimum standards for financial protection and compensation.
  • Brussels Supplementary Convention (1963): Supplements the Paris Convention by providing additional compensation through public funds when operator liability is insufficient.
  • Convention on Supplementary Compensation (CSC), 1997: A global framework providing additional compensation through an international public fund when national compensation is insufficient. It is open to states regardless of whether they are party to the Vienna or Paris regimes.
  • India: Not a party to the Paris Convention or the Vienna Convention. India ratified the CSC in 2016 and is a State Party. However, it is not currently a party to the 2026 Amendment, which revises the public-fund contribution formula for States without nuclear reactors.

  • Violation of the 'Polluter Pays' Principle: Recognised in the Indian Council for Enviro-Legal Action (1996) case, the principle requires the polluter to bear the cost of environmental harm. Under SHANTI, shifting residual liability to the Central Government could transfer the burden of private nuclear activities to taxpayers.
  • Arbitrary Classification (Article 14): Tiering operator liability by reactor size (as low as Rs 100 crore for small reactors) fails the test of reasonableness, as even a minor reactor failure can trigger severe radiation hazards.
  • Information Suppression (Article 19(1)(a)): Overriding the RTI Act, 2005 via Section 39 prevents public access to vital safety audits, undermining transparency and leaving affected citizens without the evidence needed to establish legal claims.
  • Institutional Deficits and Independence of the AERB
  • Government control over the appointment of the Chairperson and members of the AERB introduces an institutional conflict of interest, where the body promoting nuclear energy targets also oversees its regulation.
  • A nuclear safety watchdog requires complete institutional, financial, and technical autonomy from the executive to enforce uncompromising safety audits without political or commercial interference.

Measures to strengthen the framework

  • Establish an Independent Nuclear Safety Regulator: The Comptroller and Auditor General (CAG) reported an 85% shortfall in regulatory inspections of hazardous sites and flagged the absence of a National Nuclear Safety Policy. Introduce a modernised Nuclear Safety Regulatory Authority (NSRA) framework.
  • Raja Ramanna Committee (1997): Recommended amending the Atomic Energy Act, 1962 to strengthen the effectiveness of India's nuclear regulatory system.
  • NSRA Bill, 2011: Proposed establishing an NSRA with stronger regulatory powers following the Mayapuri radiation accident (2010) and the Fukushima disaster (2011). However, the Bill lapsed and did not establish a truly autonomous regulator.
  • This would address the structural conflict in which the DAE is involved in both promoting nuclear energy and overseeing its regulation.
  • Leverage the CSC's International Compensation Mechanism: India, having ratified the CSC in 2016, should develop mechanisms to access its international supplementary compensation pool, so that damage exceeding the domestic ceiling does not place the entire burden on the Indian exchequer.
  • Strengthen the India Nuclear Insurance Pool (INIP): Expand the INIP, managed by the General Insurance Corporation of India, and complement it with international reinsurance and Sovereign Catastrophe Bonds (Cat-Bonds) to cover losses beyond statutory liability limits and reduce reliance on public funds.
  • Contractual Enforcement of Supplier Liability: Since the Act weakened the statutory right of recourse, NPCIL (Nuclear Power Corporation of India Limited) and private operators must make the contractual right of recourse mandatory. As policy, all bilateral procurement contracts must explicitly encode supplier liability for latent design defects, effectively bypassing the statutory loophole while remaining CSC-compliant.
